Invitation to Bid – Vegetation Control Services

The City of Amsterdam is seeking public Bids for Vegetation Control Services at various residential or commercial properties the City. Such properties may be either City or privately owned. An updated list of properties to receive Vegetation Control will be provided to the successful bidder on a bi-weekly basis. Note that this bid is seeking a price PER EACH PROPERTY. Bids will be accepted by the City Clerk of Amsterdam until 11:00 a.m. on Thursday, May 20, 2021 when they will be opened publicly and read aloud. The Bids are for the services described above, and as further described in the following Scope of Work:

The Contractor awarded the work must perform the following Scope of Work:

1. Provided an initial clean-up of sites contained in the initially provided list. Collect trash, debris, litter, green waste, etc. and either bundle or bag. Place bundles or bags on the curb line. The City Department of Public Works (DPW) will remove this waste material from the curb line at all properties of the most up to date property list. Point of contact information within DPW will be provided to the successful bidder.

2. Cut all brush whether green or woody, and mow the subject lawns to a height of not more than 6-inches at two (2) week intervals

3. At the time of each cutting, bundle or bag litter removed during that site visit.

4. Remove all green waste from sidewalks, driveways, curb lines, etc. after each cutting.

5. Bundle green waste after each cutting and place on the curb line for DPW removal

Bidding Instructions

(A) One (1) original and one (1) copy of all Bids must be submitted in an envelope clearly marked “Vegetation Control Services”. Bids must be mailed or hand delivered to the City Clerk, Amsterdam City Hall, 61 Church Street, Amsterdam NY 12010. Bids must be mailed or hand

delivered no later than 11:00AM on May 20, 2021 when they will be opened and publicly read aloud. The entire Bid package shall be returned with the Bid (five (5) pages total.)Corrections and/or modifications received after the Bid submission date will NOT be accepted.

(B) Ditto marks or words such as “SAME” on the Bid Form are NOT considered writing and must not be used.

(C) All information must be submitted in ink or typewritten. Mistakes may be crossed out and corrections inserted. Corrections must be initialed by the person signing the Bid.

(D) Bids must be valid for up to 45 days after Bid date.

(E) Bids must be signed by an authorized person representing the legal entity of the Bidder

(F) The inability to meet any specified requirement(s) must be stated in writing and attached to the Bid form, or written on the Bid form.

(G) A Bid may not be submitted by email.

(H) A responsive Bid will include the Bid form completed as the City has presented it for public consideration. The City will not consider alternative Bids to be responsive; therefore, any alternative Bid submitted to the City in response to this Bid will be rejected.

Presumption of Bidder being fully informed

At the time the Bid is submitted, each Bidder is presumed to have read and be thoroughly familiar with all Bid documents for this project. Failure or omission of the Bidder to receive or examine any information shall in no way relieve any Bidder from obligations with respect to submitted Bid. The Bidder shall acknowledge receipt of any and all addendums which may have been issued during the advertising period on the Form of the Bid as indicated.

Interpretation of Acceptable Work

The specifications and Bid documents are to be interpreted as meaning those acceptable to the City of Amsterdam. Any substantive changes or interpretations shall be issued by the City of Amsterdam in writing as an addendum.

Prevailing Wage Rates

The work of a public contract resulting from this advertisement for bids must comply with the New York State Department of Labor Laws. Any contractor providing these services must pay employees in accordance with the prevailing wage rate schedule appropriate for the work. All invoices submitted to the City for this work must include certified payroll to verify that this requirement has been satisfied.

Workers Compensation and Disability

The successful low bidder must provide to the City a Form CE200 – Proof of Workers Compensation Insurance, and a Form DB120.1 – Proof of Disability Insurance.

Insurance

The Bidder awarded this Bid must provide a current Certificate of Insurance to the City of Amsterdam Clerk’s Office PRIOR to commencement of work, with the following requirements:

(A) General liability coverage limits for bodily injury, property damage, and personal injury, $1,000,000 per occurrence/$2,000,000 general aggregate

(B) Auto liability limits for property damage and bodily injury caused by the operation of motor vehicles, $1,000,000 per occurrence.

(C) Contractual liability, $1,000,000 per occurrence.

(D) Umbrella liability, $4,000,000 each occurrence/$4,000,000 general aggregate.

(E) Pollution liability insurance in the amount of $1,000,000 per claim/$1,000,000 annual aggregate is required.

(F) Workers Compensation, as required by New York State statute.

(G) All insurance may not be canceled or modified without thirty (30) days written notice by registered U.S. Mail to: City of Amsterdam, City Clerk, 61 Church Street, Amsterdam, NY 12010

Indemnification Requirement:

The Bidder/Contractor shall hold harmless, defend and indemnify the City of Amsterdam (“the City”) from all loss, liability, damage, penalty, expense, or fee, including attorney’s fees, or other costs or obligations which result from or arise out of the performance or breach of obligation of the Bidder/Contractor, any employee, agent, or personnel, including without limitation, claims brought against the City by third parties, employees of the City, or employees of the Bidder/Contractor. The indemnification provisions shall survive the termination of the agreement.

Contract Period

The term of this work is from the date of award continuing for a period not to exceed six (6) months during the calendar year 2021. A 2022 calendar year renewal for an additional six (6) month maximum period may be requested, at the sole discretion of the City. The City further reserves the right to terminate the work of this Contract at the end of the growing season.

Standard Form of Contractual

Agreement The City of Amsterdam intends to enter into an agreement with the successful vendor. The agreement will incorporate the provisions of the Information to Bidders, the Scope of Work, and the Bid Form submitted by the successful vendor. In the event of any conflict between the Information to Bidders and successful vendor’s Bid Form, the Information to Bidders shall prevail.

Award of Contract

The City of Amsterdam reserves the right to accept or reject, any, all, or any part of the Bids, to waive formalities or informalities and to award the Bid deemed to be in the best interest of the City.
