Planning Commission
Special use permits, as enumerated in the District Schedule of Use Regulations included at the end of the Code of the City of Amsterdam shall be considered and issued by the Planning Commission in accordance with the specific requirements of this article. Such special use permit shall be conditioned upon a separate approval by the Planning Commission, if required, under the site plan review and approval Procedure detailed in Article VIII of the Special Use Permits chapter of the city Code.
The Planning Commission shall act in strict accordance with the procedure specified by law and by the Code of the City of Amsterdam in its consideration of special permit uses. Any application for a special use permit shall be in writing, on a form prescribed by the Planning Commission and should also be accompanied by both the applicable fee in accordance with the fee schedule established and annually reviewed by the Common Council. The Planning Commission shall fix a time and place for a public hearing on any such application for special use permit and shall provide public notice thereof in the official newspaper of the city not less than twice, with the initial notice occurring at least five calendar days prior to the public hearing and final notice occurring not more than three calendar days prior to the public hearing.
The Planning Commission may attach reasonable conditions and safeguards to the issuance of any special use permit in order to ensure that the result of its action shall be as nearly as possible in accordance with the spirit and intent of the Code of the City of Amsterdam.
